These Terms govern your use of smdp.com, our newsletters, memberships, subscriptions, and all related digital services operated by Santa Monica Daily Press (“SMDP,” “we,” “our,” “us”). By accessing or using our services, including free and paid memberships, you agree to these Terms.

ELIGIBILITY

You must be at least 13 years old to use our services. Paid subscriptions require that you are 18 years old or legally able to enter into a contract.

ACCOUNTS

You may create an account to access certain features. You agree to provide accurate information, keep your login secure, and notify us of unauthorized access. We may suspend or terminate accounts that violate these Terms.

USE OF THE SERVICES

You agree not to interfere with service operations, attempt unauthorized access, scrape or extract content beyond publicly available feeds, upload malicious code, or use the services in unlawful ways. We may block or restrict use for misuse.

CONTENT OWNERSHIP

All articles, images, videos, graphics, newsletters, logos, and trademarks are owned by SMDP or our licensors. You may access content for personal use only. Republishing or redistributing content requires written permission.

If you submit content, you retain ownership but grant SMDP a non-exclusive license to use, display, distribute, modify, and archive your content. You are responsible for the content you post. We may moderate or remove content at our discretion.

PAYMENTS AND PURCHASES

Some features require payment. By making a purchase, you agree to provide accurate billing information and authorize us and our payment processor to charge your selected payment method. Taxes may apply. All sales are subject to these Terms.

EMAIL COMMUNICATIONS

By providing your email, you agree to receive service emails and newsletters if you opt in. You may unsubscribe from marketing messages at any time.

THIRD-PARTY TOOLS

Our services may use third-party integrations such as analytics tools, payment processors, commenting systems, social media plugins, email platforms, and advertising technologies. Their terms and privacy practices apply in addition to ours.

DISCLAIMERS

Our services are provided “as is.” We do not guarantee continuous access, error-free operation, availability of content, or protection from offensive material posted by users. We do not guarantee the accuracy or completeness of information on the website.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, we are not responsible for indirect, incidental, consequential, punitive, or special damages. Our total liability for any claim is limited to the amount you paid to us in the past 12 months, or $50 if no payments were made.

INDEMNIFICATION

You agree to indemnify and hold harmless SMDP from claims, losses, liabilities, and expenses arising from your use of the services, your content, your violation of these Terms, or your violation of any law or third-party rights.

TERMINATION

We may suspend or terminate your account or access to the services at any time for violations of these Terms, fraudulent activity, abusive behavior, legal requirements, or operational needs. You may request account deletion at any time by contacting members@smdp.com.

GOVERNING LAW

These Terms are governed by the laws of the State of California. Any disputes must be resolved in the state or federal courts located in Los Angeles County, California.

CHANGES TO TERMS

We may update these Terms. When we do, we will update the “Last updated” date. Ongoing use of the services constitutes acceptance of updated Terms.

MEMBERSHIP TERMS

These Membership Terms apply to all free and paid SMDP accounts, including Ghost-based logins.

TYPES OF MEMBERSHIP

Free Membership includes access to free articles, newsletters, commenting if enabled, and basic features.Paid Membership includes members-only content, premium newsletters, exclusive features, and special events. Benefits may change over time.

BILLING AND RECURRING PAYMENTS

Paid memberships may be billed monthly, annually, or as one-time purchases. By subscribing, you authorize recurring charges until you cancel. Payment processing is handled by Stripe or another provider. Taxes may apply.

FREE TRIALS

If a free trial is offered, its duration will be shown at signup. Once the trial ends, regular billing begins unless you cancel before the renewal date.

CANCELLATIONS

You may cancel your paid membership at any time in your account settings or by emailing members@smdp.com. Cancellation stops future charges but does not result in refunds for previous payments unless required by law. Your access continues until the end of the current billing period.

REFUNDS

Refunds may be issued only for billing errors, duplicate charges, or where required by law. Requests must be made within 30 days of the charge. We do not offer prorated refunds for partial billing periods.

ACCOUNT SHARING

Memberships are for individual use. You may not share your login credentials. Accounts showing excessive or suspicious simultaneous logins may be limited or suspended.

MEMBER CONTENT

If you post comments or submit content through your membership, you grant SMDP a license to use, display, and moderate that content. We may remove content at our discretion.

CHANGES TO MEMBERSHIPS

We may modify or discontinue features, pricing, benefits, or membership tiers. If pricing changes, we will notify you in advance. Continued membership constitutes acceptance of new pricing or features.

MEMBERSHIP TERMINATION

We may suspend or terminate memberships for policy violations, abusive behavior, fraud, chargebacks, or legal obligations. You may request deletion of your personal data under our Privacy Policy.

DISCLAIMERS SPECIFIC TO MEMBERSHIPS

Membership content and access are provided “as is.” We do not guarantee availability, uninterrupted access, or error-free service. Our liability is limited to the amount you paid in the past 12 months.
